What the regulations say
- 5.6 weeks a year: four weeks under regulation 13 plus 1.6 weeks under regulation 13A.
- Capped at 28 days — the extra 1.6 weeks need not exceed that.
- Bank holidays may be included in the 5.6 weeks; the law does not require them on top.
- For irregular-hours and part-year workers, 12.07% of hours worked per pay period (regulation 15B), and optionally rolled-up holiday pay at the same rate (regulation 16A), shown separately on the payslip.
- Statutory leave cannot be paid off during employment, only on termination.

How much holiday is the legal minimum?
5.6 weeks a year (regulations 13 and 13A of the Working Time Regulations 1998). For someone working five days a week that is 28 days, which is also the statutory cap — working six days a week does not produce 33.6 days.
Do bank holidays come on top?
Not as a matter of law. An employer may count bank holidays within the 5.6 weeks. Whether they are given in addition is a matter for the contract, and it is worth being explicit about it in writing.
What about irregular hours or part-year workers?
For leave years beginning on or after 1 April 2024, regulation 15B accrues leave at 12.07% of the hours worked in each pay period, capped at 28 days a year. Tick the box above to calculate it that way.
Can we pay holiday instead of giving it?
Only on termination. During employment, statutory leave must be taken, not bought out. Rolled-up holiday pay at 12.07% is permitted under regulation 16A, but only for irregular-hours and part-year workers, and it must be shown separately on the payslip.
